Disciplinary & Grievance Policy
GENERAL STATEMENT
Top Workwear UK aims to ensure that all employees are treated fairly, consistently and in accordance with natural justice when dealing with disciplinary and grievance matters. This policy is intended to maintain standards of conduct and performance while providing a clear and fair mechanism for raising concerns.
LEGAL FRAMEWORK
This policy has been developed in line with the ACAS Code of Practice on Disciplinary and Grievance Procedures and relevant UK employment legislation.
SCOPE
This policy applies to all employees and does not form part of any contract of employment.
DISCIPLINARY PROCEDURE
The disciplinary procedure addresses misconduct, poor performance or breaches of company rules.
Where appropriate, issues may be dealt with informally. Where this is not suitable, formal disciplinary action may be taken following investigation and a disciplinary meeting.
Sanctions may include:
• First written warning
• Final written warning
• Dismissal
GROSS MISCONDUCT
Gross misconduct may result in summary dismissal and includes serious breaches of health and safety, theft, violence, harassment or serious insubordination.
SUSPENSION
Employees may be suspended on full pay while investigations are conducted. Suspension is not a disciplinary penalty.
RIGHT TO BE ACCOMPANIED
Employees have the right to be accompanied at formal meetings by a colleague or trade union representative.
GRIEVANCE PROCEDURE
Employees may raise grievances in writing with a line manager or Director. A meeting will be held to discuss the grievance and a written outcome provided.
APPEALS
Employees may appeal disciplinary decisions or grievance outcomes. Appeals should be submitted in writing.
CONFIDENTIALITY
All matters will be handled sensitively and confidentially.
MONITORING AND REVIEW
This policy will be reviewed annually.
